SUMMARY OF BAIL ACT 1978 (NSW)
SECTION 8
THIS SECTION GIVES THE ACCUSED A RIGHT TO BE RELEASED ON BAIL IF:
• The offence that the accused has allegedly committed is a minor offence
• or an offence committed under the Summary Offences Act 1988 (NSW)
• or if the alleged offence is not punishable by life imprisonment nor a breach of failing to appear before the Court on a bail undertaking under section 51.
Bail can be granted conditionally or unconditionally and once a bail undertaking has been given the accused will be released into custody.
THE PRESUMPTION OF A RIGHT TO BAIL WILL BE REBUTTED IF THE ACCUSED:
• Has previously failed to comply with a bail undertaking or conditions
• Is incapacitated by injury, drug use or intoxication
• Is in danger of physical injury or in need of physical protection
• Stands convicted of the offence or the conviction is stayed
• Is currently in custody serving a sentence of life imprisonment in relation to another offence; and if the period of custody would be for a longer period than the period of bail.
• Has committed an offence where the act specifically rebuts the presumption 8A-8F.
SECTION 8A
THERE WILL BE A PRESUMPTION AGAINST BAIL IF THE ACCUSED HAS COMMITTED AN OFFENCE UNDER THE FOLLOWING ACTS:
• Certain Drug Offences under the Drug Misuse and Trafficking Act 1985.
• Drug offences under the Criminal Code of the Commonwealth 1995
• Terrorism Offences under the Criminal Code of the Commonwealth 1995
SECTION 9
THERE IS A PRESUMPTION FOR BAIL EXCEPT FOR THE FOLLOWING OFFENCES:
• Those mentioned in section 8A-8F or breaches of section 51 of the Bail Act.
• Offences relating to Murder, Attempted Murder , the use of documents to make a threat against a person’s life, aiding a person’s suicide, acts causing danger to life or bodily harm, wounding or causing grievous bodily harm with intent, certain sexual assault offences, kidnapping and certain robbery offences under the Crimes Act .
SECTION 9A-9D: FURTHERMORE TO SECTION 8A & SECTION 9:
There is an exception from the presumption of bail for certain domestic violence offences or if the accused committed the offence while either on parole, in custody, on good behaviour bond or was serving a sentence but not in custody.
SECTION 32: CRITERIA THAT WILL BE CONSIDERED WHEN DETERMINING WHETHER BAIL WILL BE GRANTED:
• Probability of whether the person will appear in court
• The background & community ties of the accused including the person details of the person’s residence, employment, family situation and prior criminal record.
• The background & community/kinship ties and other traditional ties in the case of an Aboriginal or Torres Strait Islander person.
• Whether there has been any previous failure to appear in court or breaches of any bail conditions.
• Circumstances of the offence, strength of evidence and severity of penalty.
• The interests of the accused including the length of time in custody & custody conditions.
• Whether accused needs bail to prepare for their appearance in court or to obtain legal assistance, or to be free for any other legal purpose.
• Whether the person is incapacitated by intoxication, injury or use of a drug or is otherwise in danger of physical injury or in need of physical protection.
• If the accused is under the age of 18 is an Aboriginal person or a Torres Strait Islander, or has an intellectual disability or is mentally ill or any other special needs.
• The protection of the alleged victim & their family or any other person the court considers in need of protection, the protection of the community.
• The likelihood of whether the accused would interfere with evidence, witnesses or jurors.
• Likelihood of the accused committing a serious offence while on bail.
• If the offence for which bail is being considered involved the possession or use of an offensive weapon or instrument within the meaning of the Crimes Act 1900 or any prior criminal record in respect of such an offence.
• If the offence was a serious offence or whether it was of a sexual or violent nature within the meaning of the Crimes Act 1900
